Abstract

The Measures for the Implementation of the Regulation on the Administration of the Recall of Defective Auto Products of November 27, 2015

– Appropriate Concretisation or Inadequate Bureaucratic Obstacles for Automobile Industry

On January 1, 2016, the Measures for the Implementation of the Regulation on the Administration of the Recall of Defective Auto Products came into force. The author examines (i) how effective these Implementing Measures are in concretising the Regulation on the Administration of the Recall of Defective Auto Products and (ii) whether they will promote the predictability of administrative actions and court decisions or, instead, create additional ambiguities and bureaucratic obstacles for manufacturers of automotive products. In the course of this article, he demonstrates that while the Implementing Measures do not entail significant changes when compared to the underlying Regulation, the concretisation of many regulations has nevertheless been achieved. He concludes, however, that the legality of some of the Implementing Measures remains doubtful.
