Interpretation of the Supreme People’s Court on the handling of malpractice disputes

Abstract

The updated version of the Special Administrative Measures for Access of Foreign Investment (Negative List) published by the National Development and Reform Commission of the P. R. China and the Ministry of Commerce of the P. R. China – in effect since June 28, 2018 – abolishes a number of investment obstacles of foreign investors in China in particular in the manufacturing sector. In light of such recent development, the article summarizes the still existing restrictions on foreign investment in the automobile sector and – on the basis of the Chinese language version – examines in detail the ambiguities of the current legal framework.
