Chinese proposals for enforcement legislation in respect of immovable property

As part of the future of enforcement legislation, execution against immovable property is a particularly difficult and important problem. With the development of the economy, and especially the booming of the real estate market, new problems have emerged as regards execution against immovable property. The enforcement regulations proposed in current draft legislation must be revised in terms of content so as to comply with legal and social developments. The paper focuses on regulations governing execution against real estate as have been suggested in two representative legislative drafts, thereby showing, first, the differences that exist between the drafts and existing regulations in China and, second, differences between the drafts and German regulations on executions levied against immovable property.
